1. General
Welcome to the website (qfiber.co.il) of qFiber Ltd. (2023) and its subsidiaries and affiliates, Jerusalem. Below are the terms of use and legal restrictions for using the site.
Your access to and use of the site, including the various content and services provided and/or operated on the site, is subject to the terms of use detailed below (as they are now and as they may change from time to time in the future) and any applicable law. Before browsing and/or using the site, including any provision of information of any kind on the site, please read these terms (“Terms” or “Terms of Use”) carefully. By actually using the site, including any entry or browsing of the site and/or use of the site, you acknowledge and agree that you are aware of the Terms and accept them, agree to the Terms, and declare that you have read and understood their content. The Terms will form the legal basis for any discussion between you and qFiber Ltd. and/or any of its owners and/or directors and/or any person on its behalf, including the website operators. Undoubtedly, you may not use the site in any manner contrary to the Terms of Use without obtaining prior express written consent from qFiber Ltd. If you do not accept the Terms of Use, in whole or in part, please do not browse the site or use it in any way. The terms are written in the masculine form for convenience only but refer equally to both genders.
2. Definitions
“You” or “User” – Any person browsing the site using a computer and/or any other means, including cellular communication.“Content” – Information of any kind on the site, including (but not limited to) verbal content, texts, visuals, design, graphic language, videos, music, sound, materials, data, images, photographs, illustrations, various files, graphics, links, texts, and any other information displayed on the site.
3. Use of the Site
The site is an informational website designed to provide general information about qFiber Ltd. and its products and services in the field of information technology. It is intended for potential customers, business partners, investors, and job seekers. qFiber allows you to view and download the content on the site for personal and non-commercial use only, provided you act according to the terms on the site, including all copyright and intellectual property notices contained in the content and/or any copy of it, and for legal and proper purposes only, which comply with the laws, regulations, and accepted practices in the State of Israel.
In particular, you may not alter the site and/or its contents in any way, copy, reproduce, distribute, sell, permit use, publicly display, perform, publish, create derivatives from, or create any product from the content, or use the content in any other way for any public or commercial purpose. You are prohibited from posting on the site or transmitting to it any message that includes illegal, threatening, false, misleading, racist, defamatory, privacy-infringing, defamatory, or pornographic messages, messages intended for a distribution list, chain messages, spam, or malware (including Trojans, worms, etc.), and any information about minors that identifies them, their personal details, or ways to contact them, and content that harms or infringes on the intellectual property and/or rights of others, including copyrights, moral rights, trademarks. You are prohibited from taking any action that imposes an unreasonable or disproportionately large load on the site or its associated infrastructure, or posting any materials that may constitute or encourage a criminal offense or violate any law, and you are prohibited from using the site for any illegal purpose.
4. Disclaimer of Liability
The use of the site’s content is intended for general informational purposes, as detailed in section 3 above, and should not be considered as advice from qFiber Ltd. and/or any person on its behalf, and should not be relied upon for making any decisions, including legal, commercial, professional, and other matters. The user bears full and sole responsibility for the use they make and/or will make of the site and/or the content displayed on the site. In any case, the information and content on the site are displayed for the user’s personal use only, and the use of it, including any reliance on it and/or results of its use, is solely at the user’s risk. qFiber Ltd. does not guarantee that the site will be free of viruses, worms, Trojans, or any other attack or harmful factor. Without derogating from the above, it is clarified that qFiber Ltd. uses various technologies and procedures to secure your personal information against unauthorized access, use, or disclosure, but it does not provide absolute security. Therefore, qFiber Ltd. does not guarantee that your personal information (to the extent you provide it) will be completely immune from unauthorized access. Nothing in the Terms constitutes a representation by qFiber Ltd. regarding suitability for a particular purpose, reliability, completeness, absence of errors, accuracy of the content, or non-infringement of intellectual property rights, and qFiber Ltd. will not be liable for the content and/or its accuracy and/or any independent use you make of it. qFiber Ltd. may make changes to the content, in whole or in part, at any time and without prior notice. The content on the site may not be the most up-to-date, and qFiber Ltd. does not undertake to update the content on the site at all or at any frequency. The images on the site are for illustration purposes only and are not real images.
5. Limitation of Liability
Notwithstanding any provision in any law or agreement, qFiber Ltd. and/or its controlling owners and/or its employees and/or its directors and/or any person on their behalf and/or any third party mentioned on the site shall not be liable for any damages (including, but not limited to, direct or indirect, punitive, special, consequential damages, including damages resulting from loss of profits, loss of data, loss of documents, recovery of files, business interruption, harm to reputation, etc.) related to or resulting from access to the site, use of the site, inability to use or results of using the site, or any other site linked to the site, or the content contained in the site and in each of these sites (including as a result of reliance on the content contained in the site and/or part of it), and/or as a result of exposure to computer damage (including viruses) during the use of the site, even if qFiber Ltd. has been informed of the possibility of such damages, regardless of the cause of the claim or the cause of the damage, whether contractual or tortious or otherwise. The sole remedy available to you in any event and regardless of what is stated in any law is to cease using the site.
6. Information
qFiber Ltd. does not receive confidential information from you through the site. Any material or information or any other type of communication (collectively referred to as “Messages”) that you send or post on the site will be considered non-confidential and non-proprietary. qFiber Ltd. will have no obligations regarding the Messages or related content. qFiber Ltd. and any person on its behalf will be free to copy, disclose, distribute, incorporate, and otherwise use the Messages and data, images, sounds, texts, and other elements contained in the Messages for any purpose, whether commercial or non-commercial, including direct mail, newsletters, and advertising materials (all as specified in section 7 below).
7. Collection of Information
“Job Applicants” – To respond to “Job Applicants” advertisements through the site, each user is required to provide qFiber Ltd. with identifying information about themselves, such as name, contact details, and resume (hereinafter “Candidate Information”). At qFiber Ltd. and/or its clients. The service provided to you, to the extent that it is provided, is based on the information you provided to qFiber Ltd. According to the Privacy Protection Law, 1981-5571, you confirm that you are aware and consent to it, and that the Candidate Information you provided is correct and accurate, and you provided it voluntarily, without any legal obligation to disclose it. The Candidate Information you provide when responding to “Job Applicants” advertisements will be stored in qFiber Ltd.’s database in accordance with the requirements of any law, which are detailed below. qFiber Ltd. will make every effort to ensure its ability, through the means available and accepted in the market, to secure the Candidate Information against unauthorized access, and as required by law, the Candidate Information will be used according to qFiber Ltd.’s procedures regarding the use of such information and subject to the privacy statement on this site. qFiber Ltd. reserves the right to transfer Candidate Information to third parties at the Candidate’s request and also to additional third parties at qFiber Ltd.’s discretion, for its benefit and/or the Candidate’s benefit and/or as required by law. qFiber Ltd. is entitled to use Candidate Information as follows:
Use for qFiber Ltd.’s administrative and commercial needs, among other things, to contact the Candidate, send inquiries via direct mail, marketing and advertising activities, and/or delivery of advertisements, job offers, and/or training courses, including via mail, phone, text messages, fax, or email.
Make Candidate Information available to subsidiaries and/or affiliates of qFiber Ltd. for the purposes listed above.
Make the information available to third parties who work with qFiber Ltd. for the purposes listed above.
Candidate Information that is provided and/or will be provided by you will be stored and processed in databases owned by qFiber Ltd. and/or on its behalf. We clarify that the Candidate Information is stored and processed, among other things, outside of Israel.
8. Copyright and Intellectual Property
The site and all its content are subject to copyright, moral rights, and other rights that are registered and/or used under the law of qFiber Ltd. and/or third parties. You must assume that the content on the site is protected by copyright, including laws and international conventions. The copyrights and intellectual property rights, including moral rights, on the site, the contents on it, and/or content originating from qFiber Ltd. and/or its subsidiaries and/or affiliates and/or any third party, belong to qFiber Ltd. and/or its clients and/or any third party, as the case may be. You are prohibited from modifying the content on the site in any way, including copying, reproducing, distributing, selling, permitting use, publicly displaying, performing, publishing, creating derivatives from, or creating any product from the content, or using the content in any other way for any public or commercial purpose, as detailed in section 3 above. The trademarks, including all logos, designs, texts, and other elements on the site, are the property of qFiber Ltd. and/or its clients and/or any third party, as the case may be. You are prohibited from using the trademarks in any way that violates the law, including in any way that may mislead the public.
9. Privacy
qFiber Ltd. respects your privacy and takes reasonable steps to maintain and protect it, including implementing various data security technologies to secure your personal information against unauthorized access, use, or disclosure. However, qFiber Ltd. does not provide absolute security and therefore cannot guarantee that your personal information (to the extent you provide it) will be completely immune from unauthorized access.
10. Changes to Terms of Use
qFiber Ltd. reserves the right to change, modify, add, or remove any part of these Terms of Use, in whole or in part, at any time, and without prior notice. Any change in the Terms of Use will be binding upon publication on the site, and your continued use of the site after the publication of the updated Terms will constitute your acceptance of the new Terms. It is recommended to review the Terms of Use periodically to be updated on changes.

- إتاحة معلومات المرشح للشركات التابعة و/أو الشركات التابعة في مجموعة كيو فايبر، للأغراض المنصوص عليها في الشروط.
- إتاحة معلومات المرشح لأطراف ثالثة بغرض تقديم تلك الأطراف الثالثة وظائف أو منتجات أو خدمات تعتقد كيو فايبر أن المستخدم قد يكون مهتمًا بها.
- طلب الخدمة من خلال الموقع الإلكتروني – يجوز لعملاء كيو فايبر الحاصلين على التفويض المناسب فتح طلب للخدمة في إطار عقود الخدمة الخاصة بهم من خلال الموقع الإلكتروني. كيو فايبر ليست مسؤولة بأي شكل من الأشكال عن انقطاع تفاصيل طلب الخدمة، عدم استقبال طلب الخدمة في مركز خدمة كيو فايبر، عدم الرد على طلبات الخدمة المفتوحة عبر الموقع الإلكتروني، عن أي تأخير في تقديم الخدمة بسبب إلى فتح طلب على الموقع الإلكتروني، وعدم تلقي معلومات كافية من خلال الموقع الإلكتروني، وعن أي ضرر مباشر أو غير مباشر يلحق بالعميل نتيجة لذلك. يطلب من العميل الذي يحتاج إلى خدمة عاجلة إنشاء، بالإضافة إلى فتح القراءة على الموقع الإلكتروني، اتصال هاتفي أيضًا مع مركز خدمة كيو فايبر.
- الرابط إلى الموقع على شبكة الانترنت. (روابط لمواقع أخرى) لا يجوز لك إنشاء روابط (بما في ذلك Deep linking) و/أو إشارات إلى موقع الويب من مواقع ويب أخرى، إلا بموافقة كتابية مسبقة من كيو فايبر وبموجب شروط الموافقة وأحكام أي قانون. لن تتحمل شركة كيو فايبر / أو موظفيها و / أو مديريها و / أو أي شخص ينوب عنها المسؤولية عن جميع مواقع الويب التي تحتوي على رابط لهذا الموقع، بما في ذلك المحتوى المعروض داخلها. من أجل راحة مستخدمي موقع الويب ولهذا الغرض فقط، قد يقدم موقع الويب روابط و/أو مراجع لمواقع ويب أخرى (بما في ذلك المقالات المختلفة)، ولكن من الواضح بموجب هذا أن شركة كيو فايبر لا تضمن أن جميع الروابط الموجودة على موقع الويب ستكون صحيحة وستؤدي إلى موقع إلكتروني نشط، إن مجرد وجود رابط معين على الموقع الإلكتروني لا يعني أن محتوى الموقع المرتبط موثوق به أو كامل أو محدث، ومن هنا نوضح أن شركة كيو فايبر لم تقم بإختبار مواقع الطرف الثالث هذه، وليس لديها سيطرة عليها، ولن تتحمل أي مسؤولية فيما يتعلق بها أو فيما يتعلق بالمحتويات أو البيانات أو العناصر المرئية التي تؤدي إليها الروابط و/أو شروط استخدامها. وفي حالة استخدامك لهذه الروابط و/أو المراجع فإنك ستغادر الموقع، ولا تتحمل شركة كيو فابر مسؤولية أي نتيجة تنتج عن استخدام الروابط و/أو المراجع أو من الاعتماد عليها و/أو عن استخدامها أو الاعتماد عليها المعلومات والمحتوى المنشور على الموقع من قبل أطراف ثالثة، بما في ذلك أي ضرر – غير مباشر أو مباشر – قد يلحق بك أو بممتلكاتك، إن قرار الدخول إلى أي موقع ويب خاص بطرف ثالث مرتبط بالموقع هو مسؤوليتك وحدك. للروابط، يجب عليك مراجعة شروط الاستخدام والشروط والتعليمات الأخرى الموجودة على الموقع المرتبط والتصرف وفقًا لما هو مكتوب فيها.

- تقييد الوصول – تحتفظ شركة كيو فايبر بالحق في رفض منح الوصول إلى الموقع أو أجزاء منه لأي مستخدم، وفقًا لتقديرها الخاص ودون أي إشعار مسبق.
8. أمور متنوعة
تنطبق قوانين دولة إسرائيل على هذه الشروط وعلى الموقع الإلكتروني وسيتم تفسيرها وفقًا لها. مكان الاختصاص الحصري في جميع المسائل المتعلقة بالشروط و/أو الموقع هو في المحاكم المختصة في القدس. تدير شركة كيو فايبر الموقع من مكاتبها في إسرائيل. لا تقدم شركة كيو فايبر أي إقرار بأن محتويات الموقع مناسبة أو متاحة للاستخدام خارج حدود إسرائيل. يُحظر استخدام الموقع من البلدان التي لا تطبق الشروط الواردة في هذه الوثيقة، بما في ذلك على سبيل المثال لا الحصر البلدان التي يكون فيها محتوى الموقع غير قانوني. لا يجوز لك استخدام المحتويات أو أي نسخة أو تعديل لها، أو تصديرها أو إعادة تصديرها بطريقة تشكل جريمة ضد أي قانون أو لائحة ذات صلة. إذا قررت الدخول إلى الموقع خارج حدود إسرائيل، فإنك تفعل ذلك بمبادرة منك ومسؤوليتك، وستكون مسؤولاً عن اتباع القوانين المحلية المعمول بها. تحتفظ شركة كيو فايبر بالحق في أي وقت في تحديث و/أو تغيير الشروط عن طريق تحديث هذا الإشعار، مع تحديث تاريخ آخر تحديث الذي يظهر في أعلى هذا المستند، بحيث يمكنك في أي وقت معرفة الشروط الحالية. يجب عليك زيارة الموقع من وقت لآخر للتحقق من الشروط المحدثة، حيث أنها مُلزمة من تاريخ التحديث فصاعدا. قد تسود الإشعارات و/أو الشروط القانونية المخصصة الموجودة في صفحات معينة من الموقع على بعض الأحكام الواردة في هذه الشروط. يحق لشركة كيو فايبر نقل الشروط وجميع الحقوق والالتزامات الناشئة عنها. سيتم تطبيق الشروط وملزمة الأطراف وممثليهم وورثتهم وأي ممثل آخر مفوض. ما ورد في الشروط لا يؤثر على حق شركة كيو فايبر في الامتثال للمتطلبات أو الطلبات المقدمة من الأطراف المرخص لها قانونًا فيما يتعلق باستخدام الموقع الإلكتروني أو المعلومات المرسلة إلى كيو فايبر أو التي جمعتها كيو فايبر فيما يتعلق باستخدام الموقع الإلكتروني. إذا تقرر أن أي جزء من الشروط غير صالح أو غير قابل للتنفيذ بموجب القانون، بما في ذلك على سبيل المثال لا الحصر الحد من بنود المسؤولية المذكورة أعلاه، فسيتم اعتبار البنود غير الصالحة أو غير القابلة للتنفيذ قد تم استبدالها ببنود صالحة وقابلة للتنفيذ محتواها يتوافق قدر الإمكان مع القصد من البنود الأصلية، في حين أن البنود الأخرى من الشروط ستظل سارية. إذا تنازل الطرف الآخر صراحة أو ضمناً عن حق ممنوح له وفقاً لأحكام دعوى معينة، فلا يتعلم منه حكماً مماثلاً في أي دعوى أخرى، ولا يعتبر ذلك تنازلاً عن حقوقه. تشكل هذه الشروط الاتفاقية الكاملة والكاملة بين المستخدم وكيو فايبر فيما يتعلق بالموقع الإلكتروني، وتحل محل أي اتصال أو عرض سابق أو آخر، سواء في شكل إلكتروني أو شفهي أو كتابي، تم تمريره بين المستخدم وكيو فايبر أو أي شخص آخر. نيابة عنها فيما يتعلق بالموقع.
